This Law Enforcement Request Policy (“LE Request Policy”) explains Trepy’s general approach relating to:

- court orders;
- preservation requests;
- emergency disclosure requests;
- governmental requests;
- law enforcement inquiries;
- legal process;
- related disclosure obligations.

By using Trepy, you acknowledge the practices described in this LE Request Policy.

By Agreeing to this Agreement, you are agreeing to all of the forgoing policies and terms.
1. TREPY’S ROLE
Trepy provides technology infrastructure and related services that may include:
- communications systems;
- event systems;
- ticketing systems;
- livestream systems;
- subscription systems;
- payment integrations;
- organizational management tools;
- reporting systems;
- audience engagement systems.
Trepy is not a law enforcement agency and does not independently guarantee the legality, safety, or conduct of all users, organizations, events, livestreams, communications, or transactions conducted through the platform.
Trepy reserves the right to comply with lawful legal obligations and cooperate with lawful investigations where reasonably necessary.
2. TYPES OF REQUESTS
Trepy may receive requests including:
- subpoenas;
- search warrants;
- court orders;
- preservation requests;
- emergency disclosure requests;
- governmental inquiries;
- civil discovery requests;
- regulatory requests;
- law enforcement requests.
Trepy may evaluate requests based on:
- applicable law;
- jurisdiction;
- operational feasibility;
- legal sufficiency;
- authenticity;
- scope;
- privacy considerations;
- security considerations.
Trepy reserves the right to reject, narrow, challenge, or decline requests where reasonably appropriate.
3. INFORMATION THAT MAY BE DISCLOSED
Subject to applicable law, Trepy may disclose information including:
- account information;
- registration information;
- communications metadata;
- transactional records;
- payment-related metadata;
- event participation records;
- livestream access logs;
- IP-related information;
- device-related information;
- operational logs;
- customer support records.
Trepy generally seeks to limit disclosures to information reasonably necessary to comply with applicable legal obligations.
Trepy does not guarantee the availability, completeness, or retention of any particular records.
4. CONTENT OF COMMUNICATIONS
Trepy may store or process certain communications, messages, livestream interactions, notifications, support records, or uploaded content depending on platform functionality and operational practices.
Trepy does not guarantee:
- permanent retention;
- recoverability;
- accessibility of deleted content;
- availability of archived data.
Retention practices may vary depending on:
- operational needs;
- technical limitations;
- legal obligations;
- infrastructure changes;
- security considerations.
5. PRESERVATION REQUESTS
Trepy may consider requests to preserve information relating to:
- pending litigation;
- criminal investigations;
- regulatory matters;
- fraud investigations;
- emergency situations.
Trepy reserves the right to:
- determine preservation scope;
- determine preservation duration;
- reject preservation requests;
- require formal legal process.
Preservation of records does not guarantee eventual disclosure.
6. EMERGENCY REQUESTS
Trepy may respond to emergency requests where Trepy reasonably believes disclosure is necessary to help prevent:
- imminent death;
- serious physical harm;
- certain security threats;
- certain fraud-related threats;
- certain unlawful activity.
Trepy reserves discretion regarding:
- whether circumstances qualify as emergencies;
- whether disclosures are appropriate;
- scope of emergency disclosures.
Trepy may require documentation or verification before responding.
7. USER NOTICE
Where reasonably appropriate and legally permitted, Trepy may attempt to notify affected users regarding certain legal requests.
However, Trepy may decline to provide notice where:
- prohibited by law;
- restricted by court order;
- emergency circumstances exist;
- fraud concerns exist;
- security concerns exist;
- operational risks exist;
- notice may compromise investigations.
Trepy does not guarantee user notice in all circumstances.
8. INTERNATIONAL REQUESTS
Trepy may evaluate international legal requests based on factors including:
- applicable law;
- jurisdiction;
- legal sufficiency;
- operational feasibility;
- international cooperation frameworks.
Trepy reserves the right to require requests to proceed through appropriate legal channels.
Trepy does not guarantee compliance with foreign legal requests.
9. THIRD-PARTY PROVIDERS
Trepy relies on third-party providers and infrastructure.
These may include:
- Stripe;
- Twilio;
- Mux;
- hosting providers;
- cloud infrastructure providers;
- communications providers.
Certain information may be processed or maintained by third-party providers subject to their own:
- legal obligations;
- retention practices;
- disclosure policies;
- privacy policies.
Trepy is not responsible for independent responses by third-party providers to legal requests.
10. PAYMENT-RELATED INFORMATION
Trepy may facilitate payment-related functionality through third-party providers.
Certain payment-related information may be processed, maintained, or controlled by payment processors or financial institutions.
Trepy may not possess all payment-related information requested by law enforcement or legal authorities.
Users and requesting parties may need to contact applicable financial institutions or processors directly.
11. LIVESTREAMS, EVENTS, AND COMMUNICATIONS
Trepy may receive requests relating to:
- livestream activity;
- event participation;
- ticketing records;
- communications activity;
- subscription activity;
- audience engagement activity.
Trepy reserves discretion regarding:
- availability of records;
- retention scope;
- disclosure scope;
- operational feasibility.
Trepy does not guarantee retention of livestream recordings, replay content, or communications indefinitely.
12. FRAUD, SECURITY, AND ABUSE INVESTIGATIONS
Trepy may cooperate with lawful investigations relating to:
- fraud;
- phishing;
- payment abuse;
- unlawful activity;
- intellectual property infringement;
- platform abuse;
- security threats;
- communications abuse.
Trepy may preserve or disclose information where reasonably necessary to:
- protect users;
- maintain platform integrity;
- comply with applicable law;
- reduce operational risks.
13. OPERATIONAL LIMITATIONS
Trepy’s systems and retention practices evolve over time.
Trepy does not guarantee:
- permanent retention of records;
- universal recoverability of data;
- retention of deleted content;
- availability of historical records;
- compatibility with all legal-request formats.
Operational capabilities may vary based on:
- infrastructure changes;
- technical limitations;
- retention schedules;
- system architecture;
- provider capabilities.
14. NO GUARANTEE OF DISCLOSURE
Trepy reserves the right to:
- reject requests;
- narrow requests;
- seek clarification;
- challenge requests;
- require formal legal process.
Trepy does not guarantee:
- disclosure of requested information;
- availability of records;
- response timing;
- preservation of requested data.
15. CONFIDENTIALITY
Trepy may treat legal requests, investigations, disclosures, and related communications as confidential where reasonably appropriate or legally required.
Trepy may preserve records relating to:
- requests;
- investigations;
- disclosures;
- enforcement activity.
Trepy reserves discretion regarding confidentiality practices.
16. DISCLAIMERS
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
Trepy does not guarantee:
- uninterrupted record retention;
- uninterrupted data availability;
- permanent storage of information;
- universal compatibility with legal-request formats;
- uninterrupted platform availability.
Trepy reserves broad discretion regarding responses to legal requests.
Trepy is not responsible for:
- third-party provider actions;
- legal outcomes;
- investigative outcomes;
- independent user conduct;
- independent organizer conduct;
- independent Seller conduct.
17. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREPY SHALL NOT BE LIABLE FOR:
- disclosures made in good-faith compliance with legal obligations;
- refusals to disclose information;
- unavailable records;
- deleted records;
- third-party provider actions;
- legal outcomes;
- investigative outcomes;
- indirect damages;
- incidental damages;
- consequential damages;
- punitive damages;
- reputational harm;
- lost profits.
Certain jurisdictions may not allow some limitations.
18. INDEMNIFICATION
Users, Organizers, Sellers, Treps, and commercial users agree to defend, indemnify, and hold harmless Trepy and its affiliates, officers, directors, employees, contractors, agents, and partners from claims, liabilities, damages, losses, costs, and expenses arising from:
- legal requests;
- investigations;
- disclosures;
- preservation requests;
- unlawful conduct;
- fraud;
- policy violations;
- violations of law;
- violations of this LE Request Policy.
19. GOVERNING LAW
This LE Request Policy shall be governed by the laws of the State of Georgia without regard to conflict-of-law principles.
The Federal Arbitration Act governs interpretation and enforcement of arbitration provisions.
20. BINDING ARBITRATION
Except where prohibited by law, disputes arising out of or relating to legal requests, disclosures, investigations, preservation requests, or related platform activity shall be resolved exclusively through final and binding individual arbitration.
The arbitration agreement is governed by the Federal Arbitration Act.
Either party may seek temporary injunctive relief where reasonably necessary.
21. CLASS ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- claims may only be brought individually;
- class actions are waived;
- representative proceedings are waived;
- collective proceedings are waived;
- consolidated proceedings are waived.
The arbitrator may not consolidate claims or preside over representative proceedings.
22. MODIFICATIONS TO THIS POLICY
Trepy may update this LE Request Policy from time to time.
Updated versions may be posted through the platform.
Continued use of Trepy after updates may constitute acceptance of revised terms.
