This DMCA & Intellectual Property Policy (“IP Policy”) explains:

  • how Trepy addresses intellectual property concerns;
  • how copyright complaints may be submitted;
  • how trademark or other rights concerns may be reported;
  • how Trepy may respond to infringement claims;
  • the responsibilities of platform users relating to intellectual property.

This IP Policy supplements the:

By using Trepy, you agree to comply with this IP Policy.

By Agreeing to this Agreement, you are agreeing to all of the forgoing policies and terms.


1. TREPY AS A PLATFORM PROVIDER

Trepy provides technology infrastructure that allows Users, organizations, Treps, creators, instructors, performers, event operators, and communities to:

  • publish content;
  • create events;
  • upload media;
  • livestream content;
  • communicate with audiences;
  • distribute event materials;
  • manage ticketing and engagement.

Trepy generally does not pre-screen all content uploaded or transmitted through the platform.

Users remain solely responsible for:

  • the content they upload;
  • the rights associated with that content;
  • ensuring lawful use of intellectual property.

Trepy is not responsible for independently verifying ownership rights for all uploaded or livestreamed content.

2. RESPECT FOR INTELLECTUAL PROPERTY

Users may not upload, distribute, livestream, reproduce, display, transmit, or otherwise use content that infringes:

  • copyrights;
  • trademarks;
  • publicity rights;
  • privacy rights;
  • trade secrets;
  • proprietary rights;
  • contractual rights;
  • other intellectual property rights.

Users are responsible for obtaining all necessary:

  • licenses;
  • permissions;
  • clearances;
  • synchronization rights;
  • performance rights;
  • broadcast rights;
  • livestream rights;
  • publicity permissions.

This responsibility applies to:

  • posts;
  • livestreams;
  • recorded content;
  • uploaded media;
  • event materials;
  • marketing materials;
  • organizational branding;
  • audio content;
  • music;
  • videos;
  • graphics;
  • documents.

3. COPYRIGHT INFRINGEMENT REPORTING (DMCA)

Trepy responds to copyright infringement notices consistent with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws.

If you believe that content on Trepy infringes your copyright rights, you may submit a notice containing the following information:

  • identification of the copyrighted work claimed to have been infringed;
  • identification of the allegedly infringing material and sufficient information to locate it;
  • your contact information;
  • a statement that you have a good faith belief the use is unauthorized;
  • a statement made under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner;
  • your physical or electronic signature.

Incomplete notices may delay processing.

Trepy reserves the right to request additional information before taking action.

4. COUNTER-NOTIFICATIONS

If content is removed or restricted due to a copyright complaint, the affected user may submit a counter-notification where permitted by law.

Counter-notifications may require:

  • identification of removed content;
  • contact information;
  • statements made under penalty of perjury;
  • consent to applicable legal jurisdiction;
  • statements asserting a good faith belief the content was removed by mistake or misidentification.

Trepy may restore content where permitted by applicable law unless the complaining party initiates legal proceedings.

Trepy does not guarantee restoration of content.

5. REPEAT INFRINGER POLICY

Trepy reserves the right to suspend, restrict, or terminate accounts associated with repeated infringement claims or repeated intellectual property violations.

Trepy may evaluate:

  • the number of complaints;
  • the severity of violations;
  • the credibility of reports;
  • repeat behavior;
  • operational risks;
  • legal obligations.

Trepy may act before receiving court rulings where reasonably necessary to:

  • reduce legal risk;
  • protect rights holders;
  • maintain platform integrity;
  • comply with legal obligations.

6. LIVESTREAM CONTENT AND BROADCAST RIGHTS

Trepy may support livestream and virtual event functionality.

Organizations, creators, performers, and event operators are solely responsible for ensuring they possess rights necessary to livestream content.

This may include:

  • music licenses;
  • venue permissions;
  • performance rights;
  • synchronization rights;
  • broadcast permissions;
  • publicity rights;
  • talent agreements.

Trepy may:

  • terminate livestreams;
  • remove archived content;
  • restrict broadcasting privileges;
  • suspend accounts;
  • disable access to infringing streams.

Trepy does not guarantee pre-screening of livestream content.

7. MUSIC LICENSING RESPONSIBILITIES

Users are responsible for obtaining licenses necessary for music-related content.

This may include:

  • public performance licenses;
  • synchronization licenses;
  • master use licenses;
  • mechanical rights;
  • broadcast rights.

Trepy does not provide blanket music licensing for all platform activity unless expressly stated otherwise.

Users may not assume that use of music is authorized merely because it appears elsewhere online.

8. TRADEMARKS AND BRANDING

Users may not:

  • misuse trademarks;
  • falsely imply endorsement;
  • impersonate organizations;
  • misuse logos or branding;
  • create deceptive brand associations.

Trademark complaints may be submitted where users believe content:

  • infringes trademark rights;
  • causes consumer confusion;
  • misrepresents affiliation.

Trepy reserves the right to investigate trademark-related complaints and take action where appropriate.

9. PUBLICITY, PRIVACY, AND IMAGE RIGHTS

Users are responsible for ensuring they possess rights necessary to use:

  • names;
  • likenesses;
  • photographs;
  • voice recordings;
  • video appearances;
  • identifiable personal content.

Users may not upload or distribute content violating:

  • publicity rights;
  • privacy rights;
  • contractual restrictions.

Trepy reserves the right to remove content that may violate such rights.

10. EVENT CONTENT AND ORGANIZATIONAL MATERIALS

Organizations and Treps are independently responsible for content associated with:

  • events;
  • ticketing pages;
  • livestreams;
  • promotional materials;
  • venue materials;
  • attached documents;
  • advertisements;
  • communications.

Trepy is not responsible for independently verifying:

  • ownership rights;
  • licensing status;
  • legal authorization;
  • contractual permissions.

11. USER LICENSE TO TREPY

By uploading or transmitting content through Trepy, users grant Trepy a worldwide, non-exclusive, royalty-free license to:

  • host;
  • store;
  • reproduce;
  • display;
  • transmit;
  • process;
  • adapt;
  • technically modify;
  • distribute

such content solely for purposes of operating, supporting, improving, securing, promoting, and providing the Services.

Users retain ownership of their content subject to rights granted under applicable agreements.

12. PROHIBITED INTELLECTUAL PROPERTY CONDUCT

Users may not:

  • upload infringing content;
  • unlawfully restream broadcasts;
  • pirate livestreams;
  • distribute counterfeit materials;
  • evade copyright protections;
  • remove rights management information;
  • bypass technological protections;
  • facilitate infringement.

Trepy reserves the right to investigate and take enforcement action relating to suspected infringement.

13. FALSE OR ABUSIVE COMPLAINTS

Submitting knowingly false, fraudulent, abusive, or misleading intellectual property complaints is prohibited.

Trepy reserves the right to:

  • reject abusive complaints;
  • request additional verification;
  • suspend abusive reporters;
  • pursue remedies where permitted by law.

Users may be liable for damages arising from knowingly false legal claims.

14. AUTOMATED CONTENT DETECTION

Trepy may use automated systems, moderation systems, analytics systems, or third-party tools to:

  • detect infringing content;
  • identify suspicious activity;
  • investigate reports;
  • maintain platform integrity.

Automated systems may not be perfect.

Trepy does not guarantee detection or prevention of all infringement.

15. NO OBLIGATION TO MONITOR

Trepy does not assume an obligation to:

  • pre-screen all content;
  • monitor all livestreams;
  • review all uploads;
  • verify all ownership rights;
  • investigate every complaint.

Users remain responsible for their own conduct and uploaded materials.

16. ENFORCEMENT ACTIONS

Trepy may take actions including:

  • content removal;
  • livestream termination;
  • account warnings;
  • reduced visibility;
  • messaging restrictions;
  • monetization restrictions;
  • event suspension;
  • account suspension;
  • permanent account termination;
  • legal reporting.

Trepy may act:

  • proactively;
  • reactively;
  • manually;
  • automatically;
  • based on complaints;
  • based on operational risks.

Trepy may act without prior notice where reasonably necessary.

17. THIRD-PARTY PROVIDERS

Trepy relies on third-party infrastructure and service providers.

These may include:

  • Mux;
  • Stripe;
  • Twilio;
  • cloud infrastructure providers;
  • hosting providers;
  • communication providers.

Users must comply with applicable provider policies.

Relevant provider policies may include:

Trepy is not responsible for:

  • provider restrictions;
  • third-party removals;
  • infrastructure limitations;
  • third-party enforcement decisions.

18. DISCLAIMERS

TREPY PROVIDES THE PLATFORM “AS IS” AND “AS AVAILABLE.”

Trepy does not guarantee:

  • prevention of infringement;
  • uninterrupted content availability;
  • uninterrupted livestream functionality;
  • universal moderation;
  • continuous access to uploaded content.

Trepy is not responsible for:

  • user-generated content;
  • organizational conduct;
  • unauthorized uploads;
  • infringing livestreams;
  • third-party misuse.

Users participate at their own risk.

19. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREPY SHALL NOT BE LIABLE FOR:

  • infringing user conduct;
  • unauthorized uploads;
  • livestream disputes;
  • copyright disputes;
  • trademark disputes;
  • lost profits;
  • reputational harm;
  • indirect damages;
  • incidental damages;
  • consequential damages;
  • punitive damages.

Certain jurisdictions may not allow some limitations.

20. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless Trepy and its affiliates, officers, directors, employees, contractors, agents, and partners from claims, liabilities, damages, losses, costs, and expenses arising from:

  • uploaded content;
  • livestream content;
  • infringement claims;
  • licensing disputes;
  • intellectual property violations;
  • violations of this IP Policy.

21. ARBITRATION AND CLASS ACTION WAIVER

This IP Policy is subject to the arbitration and class action waiver provisions contained in the Trepy Terms of Service.

Disputes relating to intellectual property issues, platform use, or enforcement decisions shall be resolved through binding individual arbitration governed by the Federal Arbitration Act.

Users waive participation in:

  • class actions;
  • collective actions;
  • representative proceedings;
  • consolidated claims.

22. MODIFICATIONS TO THIS POLICY

Trepy may update this IP Policy from time to time.

Updated versions may be posted through the platform.

Continued use of Trepy after updates may constitute acceptance of revised terms.
