By Agreeing to this Agreement, you are agreeing to all of the forgoing policies and terms.


1. PURPOSE OF THIS POLICY

Trepy seeks to maintain a platform that is:

  • operationally reliable;
  • reasonably safe;
  • resistant to fraud and abuse;
  • respectful of intellectual property rights;
  • compliant with applicable laws;
  • protective of infrastructure integrity.

Trepy reserves broad discretion to investigate, restrict, suspend, terminate, or otherwise limit platform access where reasonably necessary to:

  • protect users;
  • protect the platform;
  • maintain operational integrity;
  • comply with legal obligations;
  • reduce fraud or abuse risks;
  • enforce platform policies.

2. TREPY’S ENFORCEMENT AUTHORITY

Trepy reserves the right to:

  • restrict features;
  • remove content;
  • disable livestream functionality;
  • suspend messaging functionality;
  • freeze payouts;
  • limit monetization;
  • restrict ticketing access;
  • suspend accounts;
  • permanently terminate accounts;
  • remove organizations;
  • remove events;
  • disable sub-admin access.

Trepy may act:

  • proactively;
  • reactively;
  • automatically;
  • manually;
  • based on reports;
  • based on operational reviews;
  • based on legal requests;
  • based on third-party provider notices;
  • based on fraud-prevention systems.

Trepy may act without prior notice where reasonably necessary.

3. CONDUCT THAT MAY RESULT IN ENFORCEMENT

Trepy may take enforcement action relating to conduct including:

  • fraud;
  • phishing;
  • spam;
  • abusive conduct;
  • harassment;
  • violent threats;
  • unlawful conduct;
  • deceptive marketing;
  • unlawful ticket sales;
  • chargeback abuse;
  • subscription abuse;
  • payment fraud;
  • identity fraud;
  • unauthorized account access;
  • intellectual property infringement;
  • unlawful livestream activity;
  • platform manipulation;
  • security threats;
  • prohibited products or services;
  • repeated policy violations;
  • repeated customer disputes;
  • repeated operational risks.

Trepy may also take action where reasonably necessary to comply with:

  • legal obligations;
  • payment provider requirements;
  • communications provider requirements;
  • infrastructure provider requirements;
  • regulatory obligations.

4. REPEAT VIOLATOR POLICY

Trepy reserves the right to suspend or terminate accounts associated with repeated violations of:

  • platform policies;
  • intellectual property rules;
  • communications rules;
  • payment-related rules;
  • fraud-prevention requirements;
  • operational integrity standards.

Trepy may evaluate factors including:

  • number of violations;
  • severity of violations;
  • credibility of reports;
  • repeat conduct;
  • operational risk;
  • legal exposure;
  • customer harm;
  • infrastructure abuse.

Trepy reserves discretion in determining whether conduct constitutes repeat violations.

Trepy is not required to apply a fixed warning system before termination.

5. COPYRIGHT AND INTELLECTUAL PROPERTY VIOLATIONS

Trepy may suspend or terminate accounts associated with repeated intellectual property complaints or infringement activity.

Trepy may consider:

  • DMCA notices;
  • livestream infringement claims;
  • unauthorized rebroadcasting;
  • piracy activity;
  • trademark complaints;
  • repeat infringement patterns.

Trepy may take action before court determinations where reasonably necessary to:

  • reduce legal risk;
  • comply with applicable laws;
  • protect rights holders;
  • maintain platform integrity.

6. PAYMENT, FRAUD, AND CHARGEBACK ENFORCEMENT

Trepy may suspend or terminate accounts associated with:

  • excessive chargebacks;
  • fraudulent purchases;
  • suspicious payment activity;
  • transaction manipulation;
  • unauthorized transactions;
  • subscription abuse;
  • reserve deficiencies;
  • settlement risks;
  • identity fraud.

Trepy may:

  • freeze settlements;
  • establish reserves;
  • delay payouts;
  • reverse transactions;
  • restrict monetization;
  • terminate payment access.

Trepy may cooperate with:

  • payment processors;
  • financial institutions;
  • fraud-prevention providers;
  • regulators;
  • law enforcement where reasonably necessary.

7. COMMUNICATIONS ENFORCEMENT

Trepy may restrict or terminate communications functionality involving:

  • spam;
  • phishing;
  • unlawful marketing;
  • SMS abuse;
  • deceptive communications;
  • TCPA-related concerns;
  • carrier policy violations;
  • repeated messaging complaints.

Trepy may restrict:

  • email functionality;
  • SMS functionality;
  • audience messaging;
  • notifications systems.

Trepy reserves discretion regarding communications-related enforcement.

8. LIVESTREAM AND CONTENT ENFORCEMENT

Trepy may restrict or terminate livestream or content-related functionality involving:

  • unlawful broadcasts;
  • exploitative conduct;
  • repeated policy violations;
  • intellectual property violations;
  • harmful conduct;
  • abusive livestream activity;
  • unauthorized rebroadcasting.

Trepy may:

  • terminate livestreams;
  • disable replay access;
  • remove content;
  • suspend broadcasting privileges.

Trepy does not actively monitor all livestreams continuously.

9. THIRD-PARTY PROVIDER ENFORCEMENT

Trepy relies on third-party providers and infrastructure.

These may include:

  • Stripe;
  • Twilio;
  • Mux;
  • cloud infrastructure providers;
  • communications providers;
  • hosting providers.

Trepy may take enforcement action based on:

  • provider restrictions;
  • provider notices;
  • provider policy violations;
  • operational risks associated with provider requirements.

Trepy is not responsible for third-party enforcement decisions or restrictions.

10. INVESTIGATIONS

Trepy may investigate:

  • suspicious conduct;
  • fraud risks;
  • policy violations;
  • security incidents;
  • customer complaints;
  • intellectual property complaints;
  • operational threats.

Trepy may request:

  • identity verification;
  • business verification;
  • tax documentation;
  • banking verification;
  • operational documentation;
  • legal documentation.

Failure to cooperate with investigations may result in restrictions or termination.

11. APPEALS AND REVIEWS

Trepy may, but is not obligated to, provide opportunities to request review of certain enforcement actions.

Review availability may vary depending on:

  • severity of conduct;
  • fraud concerns;
  • legal obligations;
  • operational risks;
  • security concerns;
  • repeat violations.

Trepy reserves discretion regarding:

  • whether appeals are reviewed;
  • whether restrictions are modified;
  • whether accounts are reinstated.

Trepy does not guarantee reversal of enforcement decisions.

12. EFFECT OF TERMINATION

Upon suspension or termination, Trepy may:

  • disable account access;
  • remove content;
  • remove events;
  • terminate subscriptions;
  • disable ticketing;
  • disable livestream access;
  • freeze settlements;
  • preserve records;
  • maintain backups;
  • retain information where legally permitted.

Users may lose access to:

  • content;
  • livestreams;
  • tickets;
  • communications;
  • audience functionality;
  • organizational functionality;
  • digital purchases.

Trepy is not responsible for losses arising from account suspension or termination.

13. PRESERVATION OF RECORDS

Trepy may preserve information, records, logs, communications, transaction data, and operational data where reasonably necessary to:

  • investigate violations;
  • comply with legal obligations;
  • respond to disputes;
  • preserve evidence;
  • prevent fraud;
  • protect platform integrity.

Trepy may retain information following account termination consistent with applicable laws and operational requirements.

14. NO GUARANTEE OF ENFORCEMENT CONSISTENCY

Trepy does not guarantee:

  • uniform enforcement outcomes;
  • identical treatment across users;
  • continuous monitoring;
  • prevention of harmful conduct;
  • prevention of fraud;
  • uninterrupted moderation activity.

Enforcement decisions may depend on:

  • context;
  • available information;
  • operational risks;
  • infrastructure concerns;
  • legal obligations;
  • severity assessments.

15. DISCLAIMERS

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

Trepy does not guarantee:

  • uninterrupted access;
  • uninterrupted moderation;
  • uninterrupted investigations;
  • universal enforcement consistency;
  • prevention of policy violations;
  • prevention of harmful conduct.

Trepy is not responsible for:

  • user-generated conduct;
  • organizer conduct;
  • seller conduct;
  • third-party actions;
  • infrastructure limitations;
  • provider restrictions.

Trepy reserves broad operational discretion relating to enforcement decisions.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREPY SHALL NOT BE LIABLE FOR:

  • account suspensions;
  • account terminations;
  • payout freezes;
  • content removals;
  • livestream removals;
  • communications restrictions;
  • reputational harm;
  • business losses;
  • lost profits;
  • indirect damages;
  • incidental damages;
  • consequential damages;
  • punitive damages.

Certain jurisdictions may not allow some limitations.

17. INDEMNIFICATION

Users, Organizers, Sellers, Treps, and commercial users agree to defend, indemnify, and hold harmless Trepy and its affiliates, officers, directors, employees, contractors, agents, and partners from claims, liabilities, damages, losses, costs, and expenses arising from:

  • policy violations;
  • fraud;
  • unlawful conduct;
  • payment disputes;
  • intellectual property disputes;
  • communications violations;
  • platform abuse;
  • violations of law;
  • violations of this Enforcement Policy.

18. GOVERNING LAW

This Enforcement Policy shall be governed by the laws of the State of Georgia without regard to conflict-of-law principles.

The Federal Arbitration Act governs interpretation and enforcement of arbitration provisions.

19. BINDING ARBITRATION

Except where prohibited by law, disputes arising out of or relating to account restrictions, suspensions, terminations, enforcement actions, investigations, or related platform activity shall be resolved exclusively through final and binding individual arbitration.

The arbitration agreement is governed by the Federal Arbitration Act.

Either party may seek temporary injunctive relief where reasonably necessary.

20. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • claims may only be brought individually;
  • class actions are waived;
  • representative proceedings are waived;
  • collective proceedings are waived;
  • consolidated proceedings are waived.

The arbitrator may not consolidate claims or preside over representative proceedings.

21. MODIFICATIONS TO THIS POLICY

Trepy may update this Enforcement Policy from time to time.

Updated versions may be posted through the platform.

Continued use of Trepy after updates may constitute acceptance of revised terms.
